Madoff is out negating a a plea agreement. Why isn't he behind bars waiting trail? Why does the gov have to negotiate a plea? Either he is guilty or not. If guilty someone of his stature should get the maximum.

Has the gov lost all ability to prosecute high finance criminals? Are their lawyers that impotent? Or is there more to the story and they have to handle Madoff with kid gloves so he does not embarrass the higher ups involved in that scheme that wish to remain low key?

IMO, the government has not lost the ability to prosecute; they simply see no reason to do so. TPTB have discovered that no-one can punish Them for not obeying the laws of this country.
