From the beginning of his detention, Manning has been held in intensive solitary confinement. For 23 out of 24 hours every day -- for seven straight months and counting -- he sits completely alone in his cell. Even inside his cell, his activities are heavily restricted; he's barred even from exercising and is under constant surveillance to enforce those restrictions. For reasons that appear completely punitive, he's being denied many of the most basic attributes of civilized imprisonment, including even a pillow or sheets for his bed (he is not and never has been on suicide watch). For the one hour per day when he is freed from this isolation, he is barred from accessing any news or current events programs. Lt. Villiard protested that the conditions are not "like jail movies where someone gets thrown into the hole," but confirmed that he is in solitary confinement, entirely alone in his cell except for the one hour per day he is taken out.

In sum, Manning has been subjected for many months without pause to inhumane, personality-erasing, soul-destroying, insanity-inducing conditions of isolation similar to those perfected at America's Supermax prison in Florence, Colorado: all without so much as having been convicted of anything. And as is true of many prisoners subjected to warped treatment of this sort, the brig's medical personnel now administer regular doses of anti-depressants to Manning to prevent his brain from snapping from the effects of this isolation.

They haven't even given him his day in kangaroo court.

Is this supposed to elicit some sympathy for a traitor? As a member of the military, he might well be subject to the death penalty for releasing classified information. Being in isolation is chump change compared to what is getting ready to happen to him.

Sorry, I'm just not able to generate any sympathy for a guy whose former job was sitting behind a computer terminal while real men and women were being shot at or blown up in a combat zone.

Any person who--
(1) aids, or attempts to aid, the enemy with arms, ammunition, supplies, money, or other things; or
(2) without proper authority, knowingly harbors or [protects or gives intelligence to or communicates or corresponds with or holds any intercourse with the enemy, either directly or indirectly;
shall suffer death or such other punishment as a court-martial or military commission may direct.

906a. ART. 106a. ESPIONAGE
(A) (1) Any person subject to this chapter who, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any entity described in paragraph (2), either directly or indirectly, any thing described in paragraph (3) shall be punished as a court-martial may direct, except that if the accused is found guilty of an offense that directly concerns (A) nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large scale attack, (B) war plans, (C) communications intelligence or cryptographic information, or (D) any other major weapons system or major element of defense strategy, the accused shall be punished by death or such other punishment as a court- martial may direct.
(2) An entity referred to in paragraph (1) is--
(A) a foreign government;
(B) a faction or party or military force within a foreign country, whether recognized or unrecognized by the United States
(C) a representative, officer, agent, employee, subject, or citizen of such government, faction, party, or force.
(3) A thing refereed to in paragraph (1) is a document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance or information relating to the national defense.
(b) (1) No person may be sentenced by court-martial to suffer death for an offense under this section (article) unless--
(A) the members of the court-martial unanimously find at least one of the aggravating factors set out in subsection (c); and
(B) the members unanimously determine that any extenuating or mitigating circumstances are substantially outweighed by any aggravating circumstances, including the aggravating factors set out under subsection (c).
(2) Findings under this subsection may be based on--
(A) evidence introduced on the issue of guilt or innocence;
(B) evidence introduced during the sentencing proceeding; or
(C) all such evidence.
(3) The accused shall be given broad latitude to present matters in extenuation and mitigation.
(c) A sentence of death may be adjudged by a court-martial for an offense under this section (article) only if the members unanimously find, beyond a reasonable doubt, one or more of the following aggravating factors:
(1) The accused has been convicted of another offense involving espionage or treason for which either a sentence of death or imprisonment for life was authorized by statute.
(2) In the commission of the offense, the accused knowingly created a grave risk of substantial damage to the national security.
(3) In the commission of the offense, the accused knowingly created a grave risk of death to another person.
(4) Any other factor that may be prescribed by the President by regulations under section 836 of this title (Article 36).

So the Constitution, Bill of Right, none of that mean shit to you? Guilty until proven innocent means nothing to you?

It doesn't anything to the people in power, why should it mean anything to him?

Has the Supreme Court ruled that pre-trial solitary confinement is unconstitutional? If they have, I must have missed it. Private Manning will get his day in court before he is convicted of espionage. A jury of his peers as well if that is his wish.

His hero status will carry no weight at a court-martial for violations of the Uniform Code of Military Justice. I've sat as a juror in two military court-martials. The playing around and obscuration of the facts are not allowed by military judges. Its a rather grim experience but Manning won't have to wait long for a verdict. That I can assure you.

Anyone who has a security clearance is well aware of the penalties involved by leaking said information. Perhaps he is a hero to you. I'm sure that will make him quite happy as he spends the rest of his life at the United States Penitentiary - Leavenworth Kansas.

It is true that the conclusion a government judge will reach in a case between a citizen and the government is predetermined, particularly if the judge wants to keep his government career. How ridiculous that the arbiter of a conflict is also one of the contestants.

Quite true. This man is young, is he not? Young people don't always take the consequences of their actions seriously, which is unfortunate when a single boo boo can put you on Death Row. Well, from the practical perspective, its unlikely that this particular person will ever get a chance to make this mistake again.

Their is probably a morality story in here somewhere as well, young American, probably low self esteem from years of public education, joins military in hopes of finding a group he can be part of, it doesn't help self esteem, so he finds other ways to make himself "special"....and presto. His life is ruined all because he felt some psychological need.....or....he really is as dumb as a stump and didn't believe them when they told him they'd crucify him for cutting loose secrets he was oath bound to protect.

Its true Private Manning might have thought this some sort of lark or perhaps he really did feel he was doing something useful. Unfortunately those who judge these sorts of things will fail to see the humor in it. Those men and women who are serving take their oaths quite seriously and Private Manning will understand that at the conclusion of his trial.

Serious people rarely do. It is interesting, the level of defense such behavior generates even around here, among many who are cheerleading the downfall of civilization, such sensitivity to a single persons future. Amazing, the contradiction? Its okay to kill off a few billions in various rapture scenarios, but a single guy behind bars, with an alleged traitors bent? Nope...HE is getting HOSED!

Yup...serious people certainly won't be fond of those who treat service to a higher good as some sort of punchline. Maybe Manning himself will understand this....might take a few decades behind bars...but there is a chance.

Looking at the evidence released so for about the case; it looks like this was definitely a stupid kid with a chip on his shoulder. Going around bragging on the web about what he did and how; it looks like he wanted to get caught. The psychology of this is interesting. Another option is that he was honor bound to his fellow soldiers to take the rap for his crime. An interesting conundrum?

I have many friends with the same level of security clerance Manning had; in the US military and a few Australians. As much as any has ever revealed to me is that a lot of very serious 'stuff' (including genocidal level murder) goes on around the globe which is never reported. Every one of these people I have met believes that, in balance, theirs is overwhelmingly a force for good. Not one has ever revealed any specific detail of any operation. They are usually expert at speaking in defence of their country, as they are trained in ambassadorial responsibilty. Their arguments are often very strong. Some can admit that their country has made plenty of mistakes and still makes them; but they almost universally believe in the good of their government.

This case shows that there are errors in the security systems themselves (which have most likely already been fixed); but more shows a weakness in the indroctrination processes. A hunch of mine is that the growing doubt about 9/11 in particular, spreading even into the most conservative circles, could be the thin edge of the wedge in this case. There is growing doubt in private conversation with military personell about the legitimacy of action since 9/11.
Without legitimacy of action, the military quickly loses it's best people, especially at the higher end of the structure. With many of the best people stepping out early, their places are being rush filled, often with polticised appointments (ie. coloured folks). Soldiers in the field with vast experience have described being in a leadership void in both Afghanistan and Iraq over the last 2 years. They have been made to hybridise anti insurgent strategy with UN mandates; meaning they often start a job then cannot get timely authority to finish. Hundreds of thousands of soldiers are either on disability or waiting for claims. Probably most active duty veterans have a fair claim to full disability due to effects of PTSD. Besides being a hugely expensive legacy, this adds to the termite problem in the military generally.

There are hundreds of thousands of soldiers who feel the way Manning did when he allegedly did this deed against his covenant, his service and his government. The fact that he probably did it in the service of the people, who the government is supposed to be accountable to, will not bear weight at his trial. He will be locked up forever. Killing him would spook an already spooked diplomacy.

The only chance manning has is revolution.

Manning is not allowed to sleep more than 5 minutes at a time during the night. He is not allowed to sleep during the day. As we all know from the Abu Ghraib leaks, goons love sleep deprivation. Obama needs to step in and put an end to this inhuman treatment. Where is he?

No one's going to put a stop to it. Manning's treatment is going to be a warning for other whistleblower's. Just like the guy who reported the use of Swiss banks to avoid taxes and wound up in prison while the tax evaders went free. :cry:
